The ninth circuit court has upheld a ban on sending national guard in Portland, Oregon, following a latest court ruling.

Appeals Court Concurs to Rehear Legal Matter

The ninth circuit court of appeals decided on this week that it would reexamine the legal dispute concerning the president’s authority with an larger panel of 11 judges. The court also overturned a previous decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the latest development in a protracted court case over whether the former president has the legal right and valid reason to deploy state military units in Portland. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was started in response to ongoing demonstrations.

Conflicting Arguments

The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while city and state officials maintain that local officers have control of the situation.

In defiance of characterizations of the city as “war ravaged”, residents have been sharing footage of scenic paths and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two legal injunctions this month – one blocking the federal control of the state troops, and another stopping the deployment of any military personnel in the state, after attempts to evade the initial injunction by mobilizing troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing command of 200 Oregon national guard – but the second ruling remained in place, preventing the physical sending of the forces.

En Banc Review

The Tuesday decision means the issue will be heard by the full court – with all decisions under consideration together – by a group of 11 judges.

“This ruling shows that the truth matters and that the judicial system are striving to ensure government responsibility. The founding document limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The court is sending a definite signal: the executive leader cannot dispatch the armed forces into US cities unnecessarily. We will continue defending state legislation, values, and sovereignty as this case moves forward and our legal battle continues in the courts.”
